is one of plans deserving of a roll of a dice, or will congress eventually cash out again? white house correspondent wendell goler reports from sin city. >> a speech intended to pressure congress to take up immigration reform was partly rewritten to applaud bipartisan proposal announced by eight senators the day before. >> the good news is that for the first time in many years, republicans and democrats seem ready to tack thi tackle this pm together. >> president stopped short of endorsing the senate plan because aides say the legislation hasn't been written. they say the principle mirror his own. but the critics aren't so sure. the biggest difference is that mr. obama's plan would give a faster path to citizenship for the 11 million people already in the country illegally. >> yes, they broke the rules and they crossed the border illegally. maybe they overstayed the visas. those are the facts.

nobody disputes them. the 11 million men and women are now here. many of them have beenbe here for years. >> but the president's path to citizenship is too fast for florida senator marco rubio. >> the last time the country dealt with illegal immigration what it did is legalize 3 million people but did nothing about enforcement. the result is we have 11 million people at the peak, 19 million people that are undocumented. we can't repeat the mistake now. >> the senate plan calls for the boarder to be further strengthened before the illegal imgrants are allowed to begin process of paying fine and coming out of the shadows. just like under the president's plan they would under go the background checks and build back of the admission line. but the white house officials say preconditions can't be part of a fake process to put off citizenship indefinitely. illegal immigrants promised reform, hope this time it will happen. >> it will mainly be a significant change to our family.

confirmed as the next secretary of state. senators easily approved the nomination this afternoon, following the endorsement by the foreign relations committee kerry used to lead. the vote was # 4 in favor -- # 4 in favor, three against and up with present. massachusetts democratic governor dvlll patrick is expected to name interim replacement senator tomorrow. outgoing secretary of state hillary clinton will be greta van susteren's guest tonight. topics include iran, afghanistan a benghazi. >> with respect do we go back, let me explain why we are there. this was the heart of the libyan revolution. we knew there were dangerous people in and around benghazi. we also knew that there were a lot of loose weapons and part of what we were doing there was trying to get leads on recovering those loose weapons. and we knew that there were smuggling routes that could go to egypt, sinai and threaten israel. there were important reasons why we were there, not just

it has to do with moral conviction. >> it would allow the local counsels to individually decide whether to accept gays, policy of a scouting father says will be ineffectual. >> that's chaos. you have the scout and troops coming together at summer camp and adventures so it will intermix. >> the proposed plan is welcome change to organization increasingly isolated from contemporary values. >> this day and age, it's outdated. you know, to discriminate against somebody because of their sexual orientation. i believe you are born gay. and being around gays isn't going to turn you gay. >> others think scouting is no different than the military where the gays long served by not openly. >> to deny, one young boy or young man the opportunity to be in community with the

others is so sad. >> the expected aboutface comes seven month it was a bsa reaffirmed the right to exclude gays and 13 year after the supreme court ruled that private organizations have a right to exclude anybody. when, "the presence of that person affects a significant way the group's ability to advocate public or private viewpoints." the bsa may be under increasing financial pressure to accept gays. last december, the merck foundation withdrew all funding to the boy scouts saying the bsa's policy of exclusion based on sexual orientation directly conflicts with the merck foundation giving guidelines. if the change goes through as expected, the boy scouts could be in worse financial straits. two of the largest contributors are the mormon church tap catholic church. both which will frown on the acceptance of gays in the bsa. bret? >> bret: thank you. so do you think the boy scouts should change its policies on gays? let me know on twitter. follow me @brettbaier.

supreme court justice antonin scalia says the u.s. constitution is not a living document. that's acarding to the "dallas morning news." the paper quotes scalia telling an audience at southern methodist university on monday, "it's dead, dead, dead." the justice also reportedly said law schools do not adequately emphasize decisions should reflect the letter of the law. a political crisis over the debt ceiling might be further off than you think. chief congressional correspondent mike emanuel tells us about an idea to push the deadline the summer. >> sources say treasury officials told them to extent the debt creeling to mid-may could be stretched so the next deadline for action won't be until august if the senate passes the bill. to buy more time, they say extraordinary measures can be taken. the senate republican leader calls the debt crisis a chance to make the both leaner a more efficient. >> reducing the debt we eliminate an additional drag

on the economy. so this isn't a conversation about austerity. it's a conversation about growth. and opportunity. >> republicans say part of getting the nation's fiscal house in order requires cutting government spending. democratic talking point this week is spending isn't the problem. it's the media. >> i am not going to keep cutting the discretionary budget which by the way is not out of control. despite what you hear on fox news. >> though this graphic from the office of management and budget shows the growth of discretionary spending over the years and notes its expected increase through 2016. this produced by senate republicans blasts president obama for talking a good game on spending and debt but failing to deliver. >> we have kicked the can down the road. we're now at the end of the road.

december and then from december to january and finally left it open altogether. >> the most recent announcement basically said look, do what you want. get it done when you want. do something. >> bless her heart. secretary sebelius, there is no way she was ever going to meet aggressive deadlines. >> many say the federal government is way behind to set up exchanges due to be in place by october 1 in preparation for 2014. >> they failed to meet deadline in first 12 months. the fact they have a deadline that the exchanges will be up and running in 2014, is like finding a white unicorn. impossible to meet the deadline. >> h.h.s. said insisted it would meet the deadline and said we have ever expectation the federal marketplace will launch on schedule. consumers can be assured whether the state run their own marketplace, partner with us or have the federal government take the lead they can shop insurance come october 2013 and have access through coverage in a

krauthammer. rubio went on rush limbaugh and the president made his pitch. all sides are coming to one important. what about the president's pitch out and in nevada? did it help or hurt? >> i thought -- it's not clear the president wants to bill to pass in the first place. you can see a president gets everything he wants, massive win and that is good for him politically. you see where the republicans are blamed for bigots and he wins, too. the issue they are fighting is enforcement, that doesn't exist. ice and border patrol saying we can't enforce anything. dream act got to the point where if someone picked up off the street, illegal alien asked by a border patrol agent, are you here illegally, as long as he claims to have a g.e.d., no documentation, claim itself, with a g.e.d.
